You may not transfer your account to any other person without our prior written consent. Account sharing or the creation of multiple accounts by a single individual for the purpose of circumventing limitations or obtaining additional promotional benefits is strictly prohibited.

4. User Obligations and Prohibited Activities

By using our Services, you agree to use the Site and all related features solely for lawful purposes and in a manner consistent with these Terms, applicable federal and state laws, and community standards. You are solely responsible for your conduct while using the Services.

4.1 General User Obligations

• Provide truthful and accurate information in all communications and transactions with Jet's Pizza;
• Pay for all orders placed through the Site in a timely manner using valid and authorized payment methods;
• Comply with all applicable United States laws and regulations, including those governing electronic commerce, food safety, and consumer protection enforced by the Federal Trade Commission (FTC) under the FTC Act (15 U.S.C. § 45);
• Use the Services only for personal, non-commercial purposes unless otherwise expressly authorized by Jet's Pizza in writing.

4.2 Prohibited Activities

You expressly agree NOT to engage in any of the following activities:

• Using the Site for any fraudulent, deceptive, or illegal purpose, including but not limited to submitting false orders, using stolen payment credentials, or impersonating another person or entity;
• Attempting to gain unauthorized access to any portion of the Site, other user accounts, computer systems, or networks connected to the Services through hacking, password mining, or any other means;
• Introducing viruses, malware, ransomware, Trojan horses, worms, or any other malicious code into the Site or related systems;
• Scraping, crawling, or extracting data from the Site using automated tools, bots, or any other means without our prior written consent;
• Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code of any software used in connection with the Services;
• Reproducing, duplicating, copying, selling, reselling, or exploiting any portion of the Services or Site content without the express written authorization of Jet's Pizza;
• Posting or transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable;
• Using the Site to send unsolicited commercial communications (spam) to other users or third parties;
• Circumventing, disabling, or otherwise interfering with security-related features of the Site;
• Collecting or harvesting any personally identifiable information from the Site without authorization;
• Engaging in any conduct that restricts or inhibits any other person from using or enjoying the Services;
• Manipulating pricing, applying unauthorized discount codes, or exploiting system errors or glitches for personal gain.

Jet's Pizza reserves the right to investigate any suspected violations and take appropriate legal or administrative action, including removing offending content, suspending accounts, reporting to law enforcement authorities, and pursuing civil or criminal remedies.

5. Online Ordering and Payment Terms

5.1 Order Placement

When you place an order through the Site, you are making an offer to purchase food products subject to these Terms. All orders are subject to acceptance by Jet's Pizza. We reserve the right to refuse or cancel any order at our sole discretion, including orders that appear fraudulent, contain pricing errors, or exceed reasonable quantity limits.

You will receive an order confirmation via email upon successful placement of your order. This confirmation acknowledges receipt of your order but does not constitute final acceptance. Final acceptance occurs when your order is confirmed for preparation.

5.2 Pricing and Availability

All prices displayed on the Site are in United States Dollars (USD) and are subject to change without prior notice. Menu items and prices may vary by location. While we make every effort to display accurate pricing, errors may occasionally occur. In the event of a pricing error, Jet's Pizza reserves the right to cancel the order and notify you of the correction, giving you the opportunity to reorder at the correct price.

Product availability may vary by location and time of day. Jet's Pizza makes no guarantee that any particular menu item will be available at the time of your order.

5.3 Payment Methods

Jet's Pizza accepts major credit and debit cards, as well as other payment methods made available through the Site from time to time. By providing your payment information, you represent and warrant that:

• You are authorized to use the payment method provided;
• The payment information is accurate and complete;
• You authorize Jet's Pizza to charge the applicable amount to your selected payment method.

All payment processing is handled by third-party payment processors. Jet's Pizza does not store complete credit card numbers on its servers. You acknowledge that payment processing is subject to the terms and conditions of the applicable payment processor.

5.4 Taxes

All applicable federal, state, and local taxes will be calculated and added to your order total at checkout, in accordance with the tax laws of the jurisdiction where the order is fulfilled. You are solely responsible for any applicable taxes associated with your purchase.

5.5 Refunds and Cancellations

Due to the perishable nature of food products, all sales are generally final once an order has been confirmed for preparation. If you believe your order was incorrect, damaged, or otherwise did not meet reasonable quality expectations, please contact our customer support team at [email protected] within 24 hours of receiving your order. Refunds or replacements will be issued at Jet's Pizza's sole discretion on a case-by-case basis.

Jet's Pizza reserves the right to cancel orders placed in error or deemed fraudulent, and will process any applicable refunds within a commercially reasonable timeframe.

6. Delivery and Pickup

Delivery and pickup availability, areas, times, and minimum order amounts may vary by location. Estimated delivery times are provided as estimates only and are not guaranteed. Jet's Pizza shall not be liable for delays caused by traffic, weather, third-party delivery service disruptions, or other circumstances beyond our reasonable control.

It is your responsibility to provide accurate delivery address information. Jet's Pizza is not responsible for failed deliveries resulting from incorrect address information provided by the customer. Additional fees may apply for delivery services, and such fees will be clearly disclosed at checkout.

7. Intellectual Property Rights

All content available through the Site and Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the overall design and layout of the Site (collectively, "Content"), is the exclusive property of Jet's Pizza or its content suppliers and is protected by applicable United States and international intellectual property laws, including copyright law (17 U.S.C. § 101 et seq.), trademark law (15 U.S.C. § 1051 et seq.), and trade dress law.

7.1 Trademarks

The Jet's Pizza name, logo, and all related brand identifiers are trademarks or registered trademarks of the Company. Nothing in these Terms grants you any right or license to use any trademark, service mark, trade name, or trade dress of Jet's Pizza without our prior written consent. Unauthorized use of any Jet's Pizza trademarks is strictly prohibited and may constitute trademark infringement under applicable law.

7.2 Limited License

Subject to your compliance with these Terms, Jet's Pizza grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Services solely for your personal, non-commercial purposes. This license does not include the right to:

• Modify or create derivative works based on the Site or Content;
• Distribute, publicly perform, or publicly display any Content;
• Use the Site or Content for any commercial purpose;

This license is automatically revoked upon your violation of any provision of these Terms. All rights not expressly granted herein are reserved by Jet's Pizza.

9. Disclaimers — Services Provided "As-Is"

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL SERVICES PROVIDED BY JET'S PIZZA ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

JET'S PIZZA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
• ANY WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
• ANY WARRANTY REGARDING THE ACCURACY, RELIABILITY, TIMELINESS, OR COMPLETENESS OF ANY CONTENT AVAILABLE THROUGH THE SERVICES;
• ANY WARRANTY THAT DEFECTS IN THE SITE WILL BE CORRECTED.

Jet's Pizza does not warrant that food products ordered through the Site will meet your specific dietary needs, expectations, or preferences beyond what is disclosed in our available nutritional information. It is your sole responsibility to review ingredient and allergen information before placing an order. Jet's Pizza is not responsible for any adverse reactions to food products that may occur.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE UNITED STATES FEDERAL AND STATE LAW, JET'S PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES;
• LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL;
• DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES;
• DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA;
• DAMAGES ARISING FROM THE CONDUCT OF THIRD PARTIES IN CONNECTION WITH THE SERVICES;
• ANY OTHER MATTER RELATING TO THE SERVICES;

EVEN IF JET'S PIZZA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL JET'S PIZZA'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO JET'S PIZZA IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD).

Some states, including New Jersey and Massachusetts, do not allow the limitation or exclusion of liability for incidental or consequential damages, so certain limitations above may not apply to you depending on your state of residence.

11. Indemnification

You agree to indemnify, defend, and hold harmless Jet's Pizza, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, contractors, licensors, service providers, and successors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of any provision of these Terms;
• Your use or misuse of the Site or Services;
• Your violation of any applicable federal, state, or local law or regulation;
• Your infringement of any intellectual property or other rights of any third party;
• Any content you submit, post, or transmit through the Site;
• Your fraudulent, negligent, or intentionally wrongful conduct;
• Any dispute or transaction between you and any third party in connection with the Services.

Jet's Pizza reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with our defense of such claims. You agree not to settle any such matter without the prior written consent of Jet's Pizza.

12. Allergen and Food Safety Information

Jet's Pizza makes reasonable efforts to provide accurate allergen and nutritional information for menu items on the Site. However, because our food products are prepared in shared kitchen environments, cross-contact with common allergens (including gluten, dairy, eggs, nuts, soy, and others) may occur. We cannot guarantee that any menu item is entirely free from allergens.

Customers with known food allergies or dietary restrictions are strongly encouraged to contact us directly at [email protected] before placing an order. By ordering from Jet's Pizza, you acknowledge and accept the inherent risks associated with food preparation in shared kitchen environments.

13. Promotional Codes, Coupons, and Loyalty Programs

Jet's Pizza may from time to time offer promotional codes, discount coupons, or loyalty program benefits. These offers are subject to the following general conditions:

• Promotional codes are valid only for the time period and under the conditions specified at the time of issuance;
• Only one promotional code may be applied per order unless expressly stated otherwise;
• Promotional codes are non-transferable, have no cash value, and may not be combined with other offers unless explicitly permitted;
• Jet's Pizza reserves the right to modify, suspend, or discontinue any promotional offer or loyalty program at any time without prior notice;
• Abuse or fraudulent use of promotional codes will result in account suspension and may result in legal action.

15. Governing Law and Jurisdiction

These Terms of Service and any disputes arising out of or related to them or the Services shall be governed by and construed in accordance with the laws of the United States of America and applicable state laws, without regard to conflict of law principles that would cause the application of the laws of any other jurisdiction.

To the extent that any dispute is not subject to mandatory arbitration as set forth in Section 16 below, you and Jet's Pizza agree to submit to the exclusive personal jurisdiction and venue of the federal and state courts located in the United States, and you waive any objection to the exercise of jurisdiction over you by such courts.

The Services are operated from within the United States. If you access the Services from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your local jurisdiction.

16. Dispute Resolution and Arbitration

16.1 Informal Resolution

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Services informally by contacting Jet's Pizza at [email protected] with a written description of the dispute and your proposed resolution. We will attempt to resolve the dispute within thirty (30) calendar days of receiving your written notice. If the dispute is not resolved within that period, either party may proceed to formal dispute resolution as described below.

16.2 Binding Arbitration

EXCEPT AS OTHERWISE PROVIDED HEREIN, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION, OR VALIDITY THEREOF, OR THE USE OF THE SERVICES, SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") IN ACCORDANCE WITH ITS CONSUMER ARBITRATION RULES, WHICH ARE AVAILABLE AT WWW.ADR.ORG.

The arbitration shall be conducted in English and shall take place in the United States at a location mutually agreed upon by the parties, or via remote means if agreed. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of this arbitration provision.

16.3 Class Action Waiver

YOU AND JET'S PIZZA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION OR PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF A CLASS OR REPRESENTATIVE PROCEEDING.

16.4 Exceptions

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information. Additionally, claims properly within the jurisdiction of a small claims court may be brought in that forum.

17. Term and Termination

These Terms are effective as of the date you first access or use the Services and shall remain in full force and effect until terminated in accordance with this Section.

Jet's Pizza may, at its sole discretion and without prior notice, suspend or permanently terminate your access to all or any portion of the Services for any reason, including but not limited to:

• Your breach of any provision of these Terms;
• Requests from law enforcement or government agencies;
• Security or fraud concerns;
• Extended periods of inactivity;
• Discontinuation of the Services.

You may terminate your account at any time by contacting us at [email protected]. Termination of your account will not relieve you of any obligations or liabilities incurred prior to termination.

Upon termination, all licenses and rights granted to you under these Terms shall immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including without limitation Sections 7 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), 15 (Governing Law), and 16 (Dispute Resolution).

18. Changes to These Terms

Jet's Pizza reserves the right to modify, update, or revise these Terms of Service at any time and for any reason at our sole discretion. When we make material changes to these Terms, we will provide notice by:

• Updating the "Last Updated" date at the top of this page;
• Sending an email notification to the address associated with your account (if applicable);
• Displaying a prominent notice on the Site.

Your continued use of the Services after the effective date of any revised Terms constitutes your acceptance of the changes. 19. Severability

If any provision of these Terms is held by a court of competent jurisdiction or arbitrator to be invalid, illegal, unenforceable, or in conflict with any applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, it shall be severed from these Terms. The remaining provisions of these Terms shall remain in full force and effect and shall not be affected by the invalidity or unenforceability of any single provision.

The failure of Jet's Pizza to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision unless specifically acknowledged and agreed to by us in writing. A waiver by Jet's Pizza of any default shall not constitute a waiver of any subsequent default of the same or similar nature.

20. Entire Agreement

These Terms of Service, together with the Privacy Policy and any other legal notices, policies, or agreements published by Jet's Pizza on the Site, constitute the entire and exclusive agreement between you and Jet's Pizza with respect to the subject matter herein and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the Services.

No prior drafts of these Terms shall be used in the interpretation or construction of the final agreed-upon Terms. In the event of any conflict between these Terms and any other policy or agreement published on the Site, these Terms shall control unless otherwise explicitly stated.

21. Force Majeure

Jet's Pizza shall not be liable for any failure or delay in performance of its obligations under these Terms caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government orders, labor disputes, supply chain disruptions, cyber-attacks, power outages, or failures of third-party service providers. During such events, our obligations shall be suspended for the duration of the force majeure event, and we shall resume performance as soon as reasonably practicable.

22. No Waiver

The failure of Jet's Pizza to assert or enforce any right contained in these Terms shall not be deemed a waiver of that right or any future right. No waiver of any provision of these Terms shall be effective unless in writing and signed by an authorized representative of Jet's Pizza. Any waiver shall be limited to the specific circumstance in which it was given and shall not constitute a continuing waiver.

23. Assignment

You may not assign, transfer, delegate, or sublicense any of your rights or obligations under these Terms without the prior written consent of Jet's Pizza. Any attempted assignment in violation of this provision shall be null and void. Jet's Pizza may freely assign, transfer, or delegate its rights and obligations under these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, sale of assets, or other business reorganization. These Terms shall be binding upon and inure to the benefit of the parties and their permitted successors and assigns.

24. Consumer Rights Notice

Nothing in these Terms is intended to limit or exclude any rights you may have as a consumer under applicable United States federal or state law that cannot be waived by agreement. The Federal Trade Commission Act (15 U.S.C. § 45) prohibits unfair or deceptive acts or practices in commerce, and nothing in these Terms shall be construed as authorizing any conduct that violates that prohibition. If you are a California resident, additional rights may be available to you under the California Consumer Privacy Act (CCPA/CPRA) and the California Consumers Legal Remedies Act (CLRA), Civil Code § 1750 et seq.
